PROCEDURE FOR CANCELLATION

The process for patent cancellation is governed by the Patent Act, 1970, and is handled in the following manner:

  1. File a Petition for Cancellation with reasons before the Intellectual Property Appellate Board (IPAB) or before the relevant patent office.
  2. Proceedings: The IPAB or patent office will conduct hearings, if necessary, to evaluate the cancellation petition.
  3. Final Decision: After reviewing the evidence and hearing the parties, a final decision will be made to either cancel the patent or uphold it.
